J'ai donne le bail d'un ans, l'anne passe, a 2em aout, 2008.
J'ai fait loue un chambre etudiant pour 300 euros.
Maintenant, j'aimerai le faire loue a 350 euros minimum.
Est ce que jai droit de donne la preavis a mon locataire, s'elle est pas d'accord sur nouvelle loyer?

last year, 2nd of august 2008. i gave a room on rent for 300 euros on one year contract {bail enregistre}
this year, i would like to raise the price to 350 euros so i could cover all my expences that i made to change the windows to double vitrage and central heating "chauffage centrale"
i do not mind if the same locataire continue in that room but i would like to have the price 350 euros from august 2009.
for that, i would like to give her notice this month so if she would like to leave, she may leave in 3 months and i will get the new locataire from august 2009 on new price. or if she would like to stay, i could make her a new contract
can you please tell me the right way of doing the same thing ? ... can i end the current contract on 3 months notice? ... after giving the preavis, can the same locataire take the same room on new rent?

there are two rooms with shared kitchen and wash room
both room occupants have bail for their room only.

Sorry for the late reply...
If it is a first residence, and if you give yourself the leave notice, you can not increase the rent. This is the law. In practice, life is different, and nobody n-knows this law...
Personnaly, I would give the notice, and end the contract. And then, rent it to some one else with increased rent, if possible.
As this is a student room, I would rent it with a contract for student. Therefore, the applicable law will be totally different, much easier.

1- where will i get that contract from?
2- what are the differences in the contract from "residence principle"?
i am intersted in that because i have 2 appartments with 5 rooms, where i give rooms on rent only ... sometimes, it is CPAS people who rent the rooms, and sometimes students and sometimes the workers who work in brussels but live far from their work so they take the room

Iknow a very good web site proposing excellent contracts and the one you want is the "Bail de résidence secondaire"
The most important to remember is that you need a justification for the reason it is not a first residence contract. You must mention the first residence adress. The reason is that the law is protecting the first residence and does not permit to consider any adress as second residence...

i do not see any difference in the contract i have and the one you mentioned except that one has the title "residence secondaire" and other "residence principle"

The difference is essential and will be found in art.3: Destination
There is the place were you mention the reason why it is not a "résidence principale" and the place of the "résidence principale" of the locataire.
