bonjour

j'ai donne la preavis a ma locataire.
son bail ete commencer a 1ere juillet, 2007.
elle a recu son preavis a 27 mars, 2008 pour quitter la lieu a 30 juin, 2007.

elle a pas l'air d'etre serieuse.
elle m'a dit qu'elle trouver pas un appart dans l'endroit.
mais ce quand je sort dans la quartier, il y a pleins des apparts a loue.

puis elle dit qu'elle a besoin d'encore des 3 mois. bla bla bla

quelles sont les doits de ma locataire dans ce cas?
quelles sont mes droits pour la faire sortir d 'appart?
comment je doit avancer legalement pour qu'elle part de mon appartment a 30 juin?

Hi Erik,

Going to a lawyer, it is an easy thing.
But, no one ever gets to know the tricks others do with them by going to a lawyer.

Here, we are discussing the different aspects of one case. Which will bring lot of knowledge to users.

Je persiste cependant dans mon conseil, vu la tournure des événements et le fait que votre locataire ait pris un avocat: prenez un avocat également.

(ce qui ne vous empêche pas de partager les infos sur notre forum)

what lawyer is trying here?
do i oblige to send her all documents she is asking me?
why she is not going to "juge de paix" to ask any documents she needs?

I think the advice of Mr Pim is good. Your case is complex, your phrasing is approximate (sorry to say it, but it's needed) and details might mean somethings you dont want.

As for me, I will be on holyday for the next 15 days. I will not be able to answer further more.

You have the choice to signify the judgement ... or not. It's your choice.

If you signify, there is a chance you willloose more money. But then, the opposite part will be under pressure, and will have to take a decision.

If you don't signify, there is a chance you can get an explanation with the lawyer... and that she changes her mind and not go for opposition.

Personnaly, I would write to the lawyer that your request was clearly written, and that the judge did understand correctly and fully. You can ask him on what ground he wants to go on opposition, and leave him a delay of no more than 8 days to go on opposition. And explain that after this delay, if there is no communication, attempt of understanding, will to solve the problem correctly without "huissier" or other solution, you will signify.

Then, past this delay, I would signify. And when I say "would", I'm 1000% sure the delay will bring nothing but the proof they are cheating again.

Personnaly, without a letter from the lawyer mentionning on what ground he will go on opposition, I would give him NOTHING. No contract, no whatever. HE has to know what to do. You don't have to prove anything. You have a judgment. He is in the shit. You have no obligation to help him.

i am sending a letter to lawyer and giving her last 15 days.
if she replies back, good otherwise i will notify the jugement
